1. Scope and provider

These Terms and Conditions apply to HD BROWS SWITZERLAND's website-related offers, information, professional services and activities to the extent that they fall within their scope.

The provider and contractual partner for the services covered by these Terms and Conditions is UNEW Beauty Couture AG, Sinserstrasse 8, 6330 Cham, Switzerland. UNEW Beauty Couture AG is a company limited by shares under Swiss law. There are no independent German or Austrian contractual companies unless a specific offer expressly names another contracting party.

2. Relationship to the Terms of the Online Shops

Products and Training of HD Brows are offered through the relevant Online Shops. The general terms and conditions published in the respective shop apply to the specific purchase or booking.

To the extent that these Terms and Conditions and the general terms and conditions of the shop responsible for the specific offer regulate the same matter, the conditions of the respective shop take precedence.

This applies in particular to prices, VAT, conclusion of contract, payment, cancellation and rebooking of Training, no-show, delivery, shipping, return, exchange, warranty and other conditions directly related to the purchase or booking.

This applies accordingly to orders or training bookings received by telephone, email or other means of communication, as long as they are assigned to a corresponding shop offer and the Shop Terms and Conditions are included in the contract.

3. Products and Training

Information about products and Training on this website is for guidance. A representation on the website is not a binding offer unless it is expressly stated as such. Availability, content, requirements and details are subject to change; Errors and technical inaccuracies remain possible to the extent permitted by law.

Individual Training may require prior knowledge, qualifications or other requirements. UNEW can, if objectively necessary, request appropriate evidence. Transaction-related conditions are based on the Terms and Conditions of the responsible shop.

4. Professional responsibility and professional application

The professional and legally compliant application of the techniques, products and systems taught is the responsibility of the respective user.

Training, information and documents from UNEW do not replace the independent professional assessment nor the examination of the legal, official, hygienic, safety-related or professional requirements applicable at the respective place of work.

Manufacturer instructions, safety information, labels and application instructions must be adhered to.

5. Training results, certificates and no guarantee of success

Certification requires fulfilment of the requirements set for the respective training. A certificate confirms the corresponding participation or performance, but does not guarantee legal or official authorisation to carry out an activity.

To the extent permitted by law, UNEW does not guarantee a specific treatment result, economic success, customer numbers, sales, professional approval, recognition by third parties or the success of self-employment.

6. Digital content, training materials and access data

Access to digital content is personal unless otherwise agreed. Access data may not be passed on.

Digital content and training materials may not be reproduced, published, passed on or resold without appropriate authorisation, nor may they be used for unauthorised training activities of your own or third parties. Further conditions of the responsible shop remain reserved.

7. Trademark, copyright and usage rights

Trade marks, training concepts, texts, photographs, videos, presentations, teaching materials, digital content and other protected material may only be used within the scope of the granted rights. This applies to the extent that the relevant rights are owned by UNEW or may be exercised by UNEW.

Participating in a training course, accessing digital content or purchasing a product does not transfer any trademark, copyright, distribution, training or licensing rights.

8. Website, external offers and liability

UNEW neither guarantees the continuous and trouble-free availability of the website nor the completeness, timeliness or suitability of the content for a specific individual purpose. External websites and Online Shops are responsible for their own content, availability and performance.

UNEW's liability is limited to the maximum extent permitted by applicable law. Liability for intent and gross negligence remains. To the extent permitted by law, UNEW is not liable for slight negligence or for indirect and consequential damages. This applies in particular to lost profits, loss of sales, business interruption, reputational damage and other economic damage.

To the extent permitted by law, UNEW is not liable for damages or results due to improper use, failure to follow the manufacturer’s instructions, insufficient qualifications, individual reactions of customers or violation of the user's own professional or legal obligations.

Mandatory statutory liability remains unaffected.

10. Swiss law, Jurisdiction, applicable version and final provisions

Swiss law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG), to the extent permitted by law.

Jurisdiction is Zug, Switzerland, unless mandatory statutory provisions provide for a different jurisdiction. Mandatory legal provisions that apply regardless of the choice of law remain reserved.

Should a provision of this AGB be wholly or partially invalid, the effectiveness of the remaining provisions remains unaffected to the extent permitted by law.

The German version is the legally binding original version. Translations into other languages are provided for information purposes only. In the event of discrepancies, differences in interpretation or contradictions, only the German version is authoritative.
